2. Applicability
2.1 These Terms and Conditions apply to all reservations, offers and agreements relating to the rental of an Accommodation from Camperduinen, regardless of the sales channel through which the reservation is made.
2.2 The applicability of any deviating general or specific terms and conditions of the Tenant is expressly excluded.
2.3 Deviations from these Terms and Conditions are only possible in writing and explicitly.
2.4 Camperduinen is only bound by arrangements that Camperduinen has recorded or confirmed in writing.
3. Reservations and formation of the agreement
3.1 Reservations are only processed if the Tenant is 21 years of age or older. Reservations made by persons under the age of 21 are invalid and will never result in an Agreement. If Guests are under the age of 21, the Tenant must accompany them for the entire stay.
3.2 Camperduinen reserves the right, without giving reasons, to refuse non-standard reservations, in particular group reservations, or to attach additional conditions to them.
3.3 An Agreement only exists once Camperduinen has confirmed the reservation in writing by email. If the Tenant has not received a reservation confirmation within five (5) working days, the Tenant must contact Camperduinen immediately. Failing this, no rights can be derived from the reservation.
3.4 Any inaccuracies in the reservation confirmation must be reported to Camperduinen within 48 hours of receipt.
3.5 The right of withdrawal (cooling-off period) as referred to in the Dutch Civil Code does not apply to this Agreement, as it concerns the rental of holiday accommodation, which is by its nature of short duration.
3.6 The Tenant is responsible for providing correct contact details and shall ensure that all Guests and Third Parties comply with the Agreement, these Terms and Conditions and the Park Rules.
4. Price and payment
4.1 All prices stated include VAT, unless expressly stated otherwise. A booking fee is charged per reservation.
4.2 In addition to the rental price, the Tenant owes mandatory surcharges, including final cleaning, booking fees and tourist tax. The amounts of these charges are stated in the booking overview.
4.3 Tourist tax is set by the municipality of Bergen (NH). The Tenant shall at all times owe the rate set by and applicable in the municipality. Camperduinen is entitled to pass on and charge price increases resulting from changes in statutory regulations or taxes.
4.4 Within fourteen (14) days of making the reservation, 50% of the Rental Sum must be paid. The balance must be received no later than 28 days (4 weeks) before arrival.
4.5 For a reservation with an arrival date within 28 days, the full amount must be paid upon receipt of the invoice, but no later than within three (3) days.
4.6 In the event of late or incomplete payment, Camperduinen is entitled to cancel the reservation. The cancellation conditions set out in article 6 shall then apply in full.
4.7 If Camperduinen is not in possession of the full amount due on the day of arrival, it is entitled to refuse the Tenant and/or Guests access to the Accommodation, without prejudice to the right to full payment.
4.8 Payment can be made by iDEAL, credit card or bank transfer.
4.9 Discounts cannot be combined. Any discount promotions do not apply to reservations already made.
5. Changes by the Tenant
5.1 If the Tenant wishes to make changes after the Agreement has been concluded, Camperduinen is not obliged to accept them. It is at the discretion of Camperduinen whether and to what extent changes are accepted.
5.2 Changes to the arrival date and/or Accommodation within 28 days before arrival are not permitted. In that case, the cancellation conditions set out in article 6 apply.
5.3 If the Tenant wishes to change to an Accommodation or period with a lower Rental Sum, or wishes to shorten the stay, this will be regarded as a (partial) cancellation. The cancellation conditions set out in article 6 shall then apply.
5.4 If Camperduinen accepts a change, an amendment fee may be charged. In the case of a change to a higher Rental Sum, the Tenant shall pay the difference.
5.5 If the reservation is transferred in full to a third party (substitution), the Tenant must notify Camperduinen of this in writing. An amendment fee may be charged for this. Amounts already paid are deemed to have been paid by the acquiring party; the transferring and acquiring parties must settle this between themselves. Both parties remain jointly and severally liable for the performance of the Agreement.
6. Cancellation by the Tenant
6.1 In the event of cancellation, Camperduinen charges, in addition to administration costs, the following cancellation fees:
- for cancellation up to 30 days before arrival: 30% of the Rental Sum;
- for cancellation within 30 days before arrival: 90% of the Rental Sum;
- for cancellation on the arrival date or in the event of a no-show: 100% of the Rental Sum.
6.2 Cancellations must be submitted by the Tenant personally via the Guest Portal. Camperduinen confirms the cancellation in writing by email and, where applicable, sends an invoice for the cancellation fees. The cancellation is only final after written confirmation by Camperduinen.
6.3 If the cancelled period is booked (in full or in part) by a third party, nominated by the Tenant and with the written consent of Camperduinen, the cancellation fee will be refunded proportionately, after deduction of administration costs.
6.4 If the stay is ended earlier than the agreed departure date, the Tenant is not entitled to a refund of (any part of) the rental price or additional costs.
7. Cancellation by Camperduinen
7.1 In the event of force majeure or unforeseen circumstances, Camperduinen is entitled to cancel the reservation. Unforeseen circumstances and force majeure include, among other things: water damage, fire, damage to the Accommodation rendering it no longer suitable for rental, a double booking, as well as strikes, blockades and government measures.
7.2 Camperduinen will notify the Tenant of this in writing as soon as possible and will endeavour to offer equivalent Accommodation for the same Rental Sum.
7.3 If no suitable alternative can be offered or the Tenant does not accept the alternative offered, Camperduinen will refund the Rental Sum already paid (in full or in part) within fourteen (14) days. In that case, Camperduinen owes no further compensation.
8. Arrival and departure
8.1 The Accommodation can be occupied on the agreed day of arrival from 15:00. On the agreed day of departure, the Accommodation must be vacated before 10:00. Deviations are possible in consultation with the manager, subject to availability.
8.2 Keys are handed over via a key box with a code. The code is sent by email two days before arrival.
8.3 In the event of late arrival or early departure, the Rental Sum for the full reserved period remains payable.
9. Use of the Accommodation
9.1 The Accommodation is made available to the Tenant in good condition. If the Tenant believes that this is not the case, the Tenant must report this immediately to the Camperduinen manager.
9.2 The maximum number of persons permitted to stay overnight in the Accommodation is the number stated in the reservation confirmation and on the Website. Babies and children count as persons, unless stated otherwise for the Accommodation. If this number is exceeded, Camperduinen may refuse the Tenant and/or Guests access to the Accommodation, without entitlement to a refund.

In the event of non-compliance, additional cleaning costs will be charged.
9.7 Bed linen and towels can optionally be booked. If booked, the beds will be made up on arrival.

11.5 Instructions from the manager and/or Camperduinen staff must be followed at all times.

12. Liability of the Tenant
12.1 The Tenant is jointly and severally liable for the performance of all obligations under the Agreement by the Tenant, Guests and Third Parties.
12.2 During the stay, the Tenant is fully liable for the Accommodation, its furnishings and all items belonging to the Accommodation, regardless of who caused any damage.
12.3 Damage must be reported to Camperduinen immediately and, insofar as reasonably possible, compensated on site, unless the Tenant can demonstrate that the damage cannot be attributed to the Tenant or Guests.
12.4 Damage that has not been settled on site will be invoiced directly to the Tenant after departure. The Tenant is obliged to pay this invoice within the payment term stated on it.
12.5 In the event of non-compliance with the cleaning requirements, soiling or missing inventory, additional costs will be charged.
12.6 The Tenant indemnifies Camperduinen against all claims by third parties in respect of damage resulting from acts or omissions of the Tenant, Guests or Third Parties.
13. Liability of Camperduinen
13.1 Camperduinen accepts no liability for loss, theft, damage or injury of any kind caused to or by the Tenant, Guests or Third Parties, unless this is due to intent or gross negligence on the part of Camperduinen.
13.2 Use of the Accommodation and all facilities on and around the park is at the risk of the Tenant and Guests.

14. Complaints
14.1 Complaints about the stay must in the first instance be reported on site and immediately to the Camperduinen manager, so that the complaint can be resolved during the stay where possible.
14.2 If the complaint is not resolved satisfactorily, the Tenant may submit the complaint in writing to Camperduinen by email within 60 days of departure. The complaint must contain as detailed a description as possible. After this period, all rights of claim of the Tenant in respect of the complaint lapse.
14.3 Camperduinen aims to respond to complaints within 24 hours.
